Obligations when Buying & Selling your property
Each Owner’s Title is noted with a Deed of Covenant in favour of the Society. “Each Member shall prior to settling the sale of a Section procure the purchaser to enter into, execute and deliver to the Society a Deed of Covenant in favour of the Society”.
If you are intending to sell your property your lawyer is expected to ensure the appropriate process is followed in order to execute the covenant in accordance with the Rules of the Society. Please contact the Committee Chairman, Secretary or Treasurer who will be able to guide you on the process required to notify the Committee of the transfer of ownership.
Covenants, Encumbrances, Rules & Regulations
Development of the community has occurred in different stages since 1997. Individual Certificates of title have Stage specific covenants. You are encouraged to be familiar with this important information as it relates to your property because there are obligations of an Owner/Member as specified in the Rules of Tides Reach Residents Society Incorporated.
Each Member agrees to promptly and fully comply with these Rules and any regulations made by the Society from time to time, and any covenants given in favour of the Society by such Member (whether by separate Deed of Covenant or as noted against each Owner’s Title).
A copy of these documents are attached. If you have any questions relating to the Rules, Regulations and Covenants and the transfer process, as they relate to your property, please contact your solicitor for advice.
